An Irish cop who filmed himself appearing to have sex on the bonnet of a police car with an amateur porn star has won the right to keep his job.

The officer, who has not been publicly named, has been in legal limbo since the video first appeared online in April 2017 – showing him in a tryst with Carla Smith, who is also known online as Gabberlover and Carla4Garda.

Police Commissioner Drew Harris had been pushing to have the man sacked for bringing the force into disrepute, despite two disciplinary boards ruling in his favour.

Now, Ireland’s High Court has backed the boards – bringing the legal fight to an end and meaning the officer he cannot be fired over the romp.

It is not clear exactly when the ruling was made, though it was reported for the first time today by the Irish Mirror.

‘He has finally won his case,’ a source told the paper. ‘The Commissioner lost in court and that is the end of it.’

The case dates back to 2017, when the officer – who is married and has children – filmed himself appearing to have sex with Carla, who is originally from England but at the time was living in Dunmanway. 

The officer’s face remains hidden throughout the video, but he can be heard saying a number of suggestive phrases to her.

He is also filmed wearing Garda uniform and using regulation handcuffs on her, while she lays across the bonnet of a police car.

The footage was then posted online, where it attracted a lot of attention.

That sparked an internal police probe which identified the officer using information visible on one of the vehicles.

He was subsequently suspended, though reinstated in mid-2018 with a warning that he was facing disciplinary action. 

A disciplinary board then ruled on the case, saying the officer should be fined three weeks’ pay but should keep his job.

Commissioner Harris overruled, saying the officer had brought the force into disrepute and deserved to be sacked.

A second disciplinary board also ruled in the officer’s favour, before the case ended up in the High Court.

There, a judge decided that the commissioner had been wrong to overrule the boards and that their ruling should stand, bringing the case to a close. 

A spokesman for the Garda refused to comment.

The video earned Carla widespread notoriety in Ireland, where she was already semi-famous having featured in a separate video with two members of the armed forces.

Speaking about the videos back in 2017, she described them as ‘a bit of craic’ and revealed she had approached the officer after her previous videos caught attention.

She described him as ‘well game’ for the idea, provided he could not be identified.

Carla also admitted sharing the footage online without asking his permission, though said she wasn’t aware he was married with children.

At the time it was rumoured there might be more footage, though Carla was quick to snuff that out.

‘No, absolutely not. There is nothing coming, alright? There is nothing, I’m leaving it. That is it, it’s done,’ she said.

Urging journalists to move on to another story, she added: ‘We are on the brink of World War III and all you can think about is me. Seriously, come on.’
